Terms of use

1. Identification of the publisher

The Notenda application is published by Fabulette, the personal project of an independent developer. Notenda is distributed free of charge, with no advertising, no in-app purchase and no subscription: publishing this application is not a commercial activity.

In accordance with French law no. 2004-575 of 21 June 2004 on confidence in the digital economy, a non-professional publisher is not required to publish their personal contact details. These are held by the website’s hosting provider, who keeps them available to the judicial authorities.

2. Description of the service

Notenda is a personal journal application for writing, organising and finding notes, notebooks and files. It runs entirely on your device: your data is never sent to, stored on, or backed up to a server. There is no account to create, and no internet connection is required to use it.

Main features:

• Creating and managing personal notebooks, categories and memos.
• Attachments: photos, documents and files attached to a memo, kept on your device.
• Text and document scanning: your device’s camera recognises the text on a page or a receipt (OCR) and inserts it into a memo. Processing is local; no image is sent anywhere or kept anywhere other than on your device.
• Automatic deletion: a memo can be set to erase itself at a time you choose.
• Notifications: local reminders, issued by your device, without going through a server.
• Backup and restore: export of a ZIP archive containing your data and your attached files, which can be imported back into the application. PDF export to keep or pass on a selection of memos.

What Notenda does not do: no synchronisation between devices, no online storage, no advertising, no subscription, no sale of data.

The application does send anonymous usage statistics, tied to a session rather than to a person, described in the Notenda privacy policy.

User responsibility: the user is solely responsible for the content they enter in the application. Notenda is not designed to store sensitive data (e.g. banking information). The user undertakes not to use the application for illegal purposes or purposes contrary to public order.

3. User obligations

• Lawful use: the user undertakes not to use the application for illegal or harmful activities.
• Backups: Notenda keeps no copy of your data. Loss, theft or a factory reset of the device means the permanent loss of anything that has not been exported. It is up to the user to export their data regularly.
• Content: the user warrants that they own the data and files they add, and indemnifies Notenda against any claim relating to their content.

4. Intellectual property

• User content: the user remains the owner of the notebooks, photos and files they create or import. Notenda claims no rights over this content, to which it has no access in any case.
• Application: the code, design and features of the application are protected by copyright. Any unauthorised reproduction or modification is prohibited.

5. Limitation of liability

Notenda cannot be held liable for:

• Loss of data following the loss, theft or failure of the device, a factory reset, uninstalling the application, or the absence of a prior export.
• Indirect damages (e.g. loss of profits, loss of data) resulting from use of the service.
• Content added by the user.

6. Changes to these terms

These terms may be amended at any time, in particular if the application evolves towards new services. Users will be informed by a notification in the application. Continuing to use the application constitutes acceptance of the new terms.

7. Ending use

There is no account to close. Users stop using Notenda whenever they wish, by uninstalling the application. The steps for erasing your data are given on the Delete your data page.

8. Governing law and disputes

These terms are governed by French law. Any dispute will be submitted to the competent French courts.
